Presenters will use the UIDP Contract Accords as practical guidance to help participants understand issues and collaborate more effectively.

Topic: Background Intellectual Property

Some research projects require access to or use of existing intellectual property of one or both parties for the research to be performed.  This session will review expectations and perspectives of universities and industry sponsors with respect to background intellectual property (BIP). We will discuss when and how to include BIP clauses to mitigate the risk that the sponsor or the university may not have access to BIP that may be needed to conduct the project or to use resulting intellectual property and to properly recognize BIP as an asset of a party.

Melinda Vander Velden, Pioneer Hi-Bred International

melinda-vMelinda Vander Velden is a Licensing Manager at Pioneer Hi-Bred International, Inc., and owner of a solo practice law firm, Vander Velden Law Firm, LLC.  Before joining Pioneer’s Technology Transfer and Licensing group, she served as a Patent Agent at Pioneer supporting the germplasm and mechanical dockets.  Melinda received a J.D. from Drake University Law School in 2010, an M.S. in Electrical Engineering from Iowa State University in 2002, and is a registered patent attorney.

 

Elaine Brock, UIDP Contract Accords Manager

Elaine UIDPElaine is a Project Manager for the UIDP, managing the Contract Accords and Master Agreements projects, both of which develop practical guidance and materials to help parties negotiating collaborative research agreements. She is President & Senior Partner at Contracts, Compliance, and Conflict of Interest Authority, LLC, where she provides advice and counsel to universities and small business on research administration issues.

Moderator: Tony Boccanfuso

TB_headshotAs the UIDP’s President, Tony is a leading expert on U-I relations, in print and on the speaker circuit, domestically and internationally. Tony holds a Ph.D. in Inorganic Chemistry from the University of South Carolina and a B.S. in Chemistry and Political Science from Furman University. Tony also serves as a consultant for government agencies, non-profit organizations and corporations and is Chair of the MedStar Health Research Institute. Tony and his family currently reside in Connecticut, where Tony’s wife, Dr. Laura Boccanfuso, is a social robotics researcher at Yale.
