academy-blueThis UIDP Academy series presents information and ideas from leading subject matter experts on tried, true, and new approaches to U-I contracting, with opportunities for Q&A and presenter interaction. Presenters will use the UIDP Contract Accords as practical guidance to help participants understand issues and collaborate more effectively.

Topic: Software

This session will explore issues related to the protection, licensure, and use of software in industry sponsored research agreements. Topics will include differences in types of software (e.g., executable v. source code), applicability of copyright and patent law. Perspectives of universities and industry will be discussed re public access, open source, and public licensing.

Presenters:

Laurie Kuhl, Purdue University

Laurie Kuhl is the Director of Contracting, Sponsored Program Services, at Purdue University, where She ensures that the university’s contract negotiations operate responsively and smoothly to process more than 20 percent of the university’s operating revenue. Her team takes into consideration the varying needs of research sponsors, ranging from federal and state government, to foundations and private corporations. She was recently published in the National Council of Research Administration’s Prism of Research Administration issue for her thoughts on “T It Up: Running a High Volume Contracting Division” and spoke at the Indiana Forum for Research Administration on “Negotiating Difficult Terms & Conditions.”

Laurie’s broad background includes experience in the public and private sector.  She served as a staff attorney in the federal district court and state appellate court, chief of staff in city government, and she practiced business litigation for private law firms. She has a deep understanding of the laws and policies affecting the intersection between government and business.

Susan Capello, Intel

Susan A. Capello is a Senior Intellectual Property Counsel for Intel Corporation, with responsibilities focused on supporting HealthCare Life Science Group, Intel’s University engagements and New Technology Group, including New Device business, New Business Initiatives, Intel Labs and Perceptual Computing. She graduated from West Chester University of Pennsylvania with a Bachelor of Science in Chemistry/Biology and Business Administration and worked in scientific research capacities with Hoffman-LaRoche, Inc. and the Rorer Group, Inc. Ms. Capello received her Juris Doctor from Pace University School of Law in 1989 and admitted to practice in New York in 1990. Ms. Capello spent several years in private practice before becoming an in-house IP attorney. As in-house counsel she has worked for Becton, Dickinson and Company; Lipid Sciences, Inc. and Connetics Corporation before joining Intel Corporation.

Moderator: Elaine Brock, UIDP Contract Accords Manager
Elaine is a Project Manager for the UIDP, managing the Contract Accords and Master Agreements projects, both of which develop practical guidance and materials to help parties negotiating collaborative research agreements. She is President & Senior Partner at Contracts, Compliance, and Conflict of Interest Authority, LLC, where she provides advice and counsel to universities and small business on research administration issues.
